The aim of this volume is to provide an exhaustive and updated analysis and discussion of the philosophy of Liang Shuming 梁漱溟 (1893–1988), one of the most contested figures of modern Chinese intellectual history. For the last 100 years, his thought has been interpreted in such contrasting and contradictory ways—as Buddhist, Confucian, and Marxist, as conservative and modernist—that it seems at times difficult to grasp who the “real” Liang was. This essay draws some consequences affecting juridical rationality, particularly its normative theory, from the discussion of Ricoeur’s philosophy of law by Alain Papaux and François Ost. It emphasizes in particular the ambiguities of Papaux’s position regarding the notion of abduction and stresses the irreducibility of the hermeneutic dimension of legal argument.

Cet article montre comment Ricœur a constitué une théorie de la causalité adaptée à sa philosophie pratique. D’abord, on étudie la définition alternative de la causalité qu’élabore Ricœur pour les sciences historiques, caractérisée par la conditionnalité, la processualité et la singularité. Ensuite, on souligne l’effort de justification objective de cette nouvelle catégorie causale par une démarche logico-transcendantale, qui lie les conditions de possibilité d’une connaissance objective de l’action non pas à une subjectivité fondatrice, mais à des dimensions du discours. Que fait la justice numérique à la théorie et à la pratique du droit? Qu’induit-elle pour la vocation de justice de l’institution judiciaire? Comment en bouleverse-t-elle les différents métiers? Jean Lassègue et Antoine Garapon mènent une enquête approfondie pour différencier soigneusement les deux formes symboliques du numérique et du droit. Ils s’efforcent ainsi de ménager ainsi une troisième voie qui sache éviter tout autant la fascination dogmatique des juristes pour la tendance « loi et mathématique » (la tentation de fonder (...) la rationalité juridique sur la formalisation) que l’ambition légale démesurée de l’informatique contemporaine (la prétention actuelle des algorithmes à empiéter sur tous les domaines, y compris le droit). In this article, I try to reconstitute the inchoative debate that took place between Ricœur and Grünbaum concerning the epistemology of Freudian psychoanalysis. The debate was more inchoative than effective because of its asymmetry. First, I will underline the originality of Ricœur’s theory of motivation and causality. Then, I will examine the rest of Grünbaum’s objections: the overvaluation of clinical relationship and language, the ontological specificity of psychical reality, the narrative originality of the psychoanalytical explanation and the status of symbol. In this article, I underline the profound link existing between Ricœur’s practical philosophy and language. Indeed, the latter bestows unity upon the former, because it constitutes its main axis, for methodological reasons. First of all, I recall Ricœur’s definition of discourse and explain its various transphrastic dimensions. I then show how this philosophy of language is carefully used to build a very coherent logic of judgment, which underlies all Ricœur’s epistemological reflections about normative disciplines. Dans cet article, je cherche à expliquer la définition de la philosophie ricœurienne en examinant deux de ses conditions les plus fondamentales: la signification, qui en constitue en quelque sorte le matériau, et la réflexivité, qui est le principe de son articulation dynamique. Je procède en deux temps. J’étudie d’abord les cinq différents niveaux du discours, en soulignant l’originalité de chacun d’eux: descriptif, transphrastique, auto-compréhensif, anthropologique, métaphysique. J’explique ensuite le rôle que joue la réflexivité, dans sa dimension intra- et inter-sémiotique, (...) pour à la fois délimiter ces différents niveaux et permettre un passage de l’un à l’autre. Je conclus en montrant que toute la philosophie de Ricœur se caractérise par une confiance accordée au langage: à son effort obstiné et prudent pour “éclairer l’existence” en repoussant les limites de ce qui le borde. « Le présent article voudrait éclairer le paradoxe sous-jacent à l’idée d’une clinique du social. À première vue, en effet, l’orientation clinique est synonyme d’attention à l’individuel, au singulier, à l’unique, tandis que le social désigne plutôt des aspects collectifs, génériques, réitérés. De sorte que l’oxymore du clinique-social ne semble guère avoir de pertinence. Pourtant, force est de constater, depuis une trentaine d’année, une diffusion importante du terme de clinique dans les sciences humaines et sociales. Comment rendre compte d’une telle (...) inflation? En fait, la diffusion de l’expression de clinique dans ces disciplines a commencé au début du xx e siècle. D’ambition surtout informative, l’article examine successivement comment la psychologie clinique a pu revendiquer une extension sociale, puis comment ont pu naître et se légitimer les projets, plus ou moins autonomes et indépendants, d’une sociologie et d’une anthropologie clinique. The multiplier is a central concept in Keynesian and post-Keynesian economics. It is largely what justifies activist full-employment fiscal policy: an increase in fiscal expenditures contributing to multiple rounds of spending, thereby financing itself. Yet, while a copingstone of post-Keynesian theory, it is not universally accepted by all post-Keynesians, for reasons vastly different than the mainstream. This book explores both the pros and cons of the multiplier from a strictly post-Keynesian – and Kaleckian – approach. The complexity of industrial reality, the plurality of legitimate perspectives on risks and the role of emotions in decision-making raise important ethical issues in risk management that are usually overlooked in engineering. Using a questionnaire answered by 200 engineering students from a major engineering school in Canada, the purpose of this study was to assess how their training has influenced their perceptions toward these issues. While our results challenge the stereotypical portrait of the engineer, they also suggest that the current (...) engineering education might fail to empower engineers to engage in ethical risk management. We therefore propose an active-learning method to help in this matter. Carried out through workshops with 34 students in chemical engineering, the effectiveness of this method has been evaluated using group interviews and questionnaires. Our results suggest that such an approach is effective, at least in the short run, to motivate students to engage in ethical risk management and to trigger reflectivity on what it means to be an engineer today. Risk management is certainly one of the most important professional responsibilities of an engineer. As such, this activity needs to be combined with complex ethical reflections, and this requirement should therefore be explicitly integrated in engineering education. In this article, we analyse how this nexus between ethics and risk management is expressed in the engineering education research literature. It was done by reviewing 135 articles published between 1980 and March 1, 2016. These articles have been selected from 21 major journals (...) that specialize in engineering education, engineering ethics and ethics education. Our review suggests that risk management is mostly used as an anecdote or an example when addressing ethics issues in engineering education. Further, it is perceived as an ethical duty or requirement, achieved through rational and technical methods. However, a small number of publications do offer some critical analyses of ethics education in engineering and their implications for ethical risk and safety management. Therefore, we argue in this article that the link between risk management and ethics should be further developed in engineering education in order to promote the progressive change toward more socially and environmentally responsible engineering practices. Several research trends and issues are also identified and discussed in order to support the engineering education community in this project. (shrink)

Institutions in France are not yet well prepared to respond to allegations of scientific misconduct. Following a serious allegation in late 1997. INSERM,* the primary organization for medical and health-related research in France, began to reflect on this subject, aided by scientists and jurists. The conclusions have resulted in establishing a procedure to be followed in cases of alleged misconduct, and also in reinforcing the application of good laboratory practices within each laboratory. Guidelines for authorship practices and scientific assessment must (...) also be considered. Even though each institution must remain responsible for responding to allegations of scientific misconduct within its doors, INSERM would like to see national, European, and international co-ordination about the methods of such response. The increasing availability of brain data within and outside the biomedical field, combined with the application of artificial intelligence (AI) to brain data analysis, poses a challenge for ethics and governance. We identify distinctive ethical implications of brain data acquisition and processing, and outline a multi-level governance framework. This framework is aimed at maximizing the benefits of facilitated brain data collection and further processing for science and medicine whilst minimizing risks and preventing harmful use. New concepts may prove necessary to profit from the avalanche of sequence data on the genome, transcriptome, proteome and interactome and to relate this information to cell physiology. Here, we focus on the concept of large activity-based structures, or hyperstructures, in which a variety of types of molecules are brought together to perform a function. We review the evidence for the existence of hyperstructures responsible for the initiation of DNA replication, the sequestration of newly replicated origins of replication, cell division (...) and for metabolism. The processes responsible for hyperstructure formation include changes in enzyme affinities due to metabolite-induction, lipid-protein affinities, elevated local concentrations of proteins and their binding sites on DNA and RNA, and transertion. Experimental techniques exist that can be used to study hyperstructures and we review some of the ones less familiar to biologists. Finally, we speculate on how a variety of in silico approaches involving cellular automata and multi-agent systems could be combined to develop new concepts in the form of an Integrated cell (I-cell) which would undergo selection for growth and survival in a world of artificial microbiology.
